ANNAPOLIS, Md. — Anne Arundel County Executive John Leopold’s attorneys have rested their case in his trial on misconduct in office charges.

Attorney Bruce Marcus on Monday urged Judge Dennis Sweeney to throw the case out of court. Marcus contends the allegations that Leopold used his police detail for personal and political purposes are too vague and do not constitute crimes.

Sweeney decided to let the case move forward.

Closing arguments are scheduled for Tuesday morning.

Leopold, a Republican in his second term as county executive, faces three charges of misconduct in office and a charge of misusing county money for personal benefit.

He faces up to five years in prison, if found guilty on the misuse of county money. The penalty for misconduct of office is determined at the judge’s discretion.
